As reported by KSAT, Rob & Dee Roberson and others like them are quite concerned they may be evicted from the property they believed was leased for life, due to the property owners filing bankruptcy. It's reported that the court has rendered the leases unenforceable.
The residents at El Viaje Retreat prepaid large sums of money for the lifetime leases when they moved in and have invested large sums to improve the properties. They never thought of the improvements as a waste of money because they believed they'd have the ability to reside there until the end. They have made considerable improvements, to include sprinkler systems, extensive landscaping and much more.
Their attorney, Carole Boyd, would like a state court to hear this case, and not a Bankruptcy Court. She states that this situation is "scary." She is hoping to have the case remanded back to the State Court.
The residents have already had an expensive battle over this and feel they can't quit now. They're hoping that they will be able to remain in their homes.
